How we restructured a Cardiff independent producer for substantial efficiency

Client L is an independent television producer and post-production specialist based in the Cardiff Bay production cluster, working with BBC Wales, S4C and London-based commissioners. He had been trading as a sole trader for seven years on around £135,000 of annual production income, losing his entire personal allowance to the taper, paying Class 4 NIC on the full self-employed profit, with no pension being built and a recent £35,000 investment in a 4K editing suite that had been bought personally rather than through any tax-efficient structure.

We handled the incorporation, the transfer of his existing production contracts (with appropriate IR35 review of any single client representing more than around 40 per cent of his income), the asset transfer with market valuation, the opening balance position, the PAYE registration, and the salary-dividend schedule for the first three years. He now has a tax-efficient operating structure, a serious pension being built, a clean asset position for the editing suite, and the capacity to take on a permanent post-production assistant as a PAYE employee in the next financial year.

The personal allowance, the threshold for higher and additional rates, the rates on savings and dividends, capital gains tax, inheritance tax, corporation tax, and national insurance contributions are all reserved to the UK Government and apply uniformly across Wales and England. In practice this means for now your Welsh self-assessment liability is identical to what it would be in England, but the position could diverge in future budgets. HMRC identifies Welsh taxpayers by your main residence (a C-prefix on your tax code, so a code like C1257L) and you should make sure your address on file with HMRC is current.
