How we cleared the penalty backlog for a Liverpool self-employed maritime consultant

Client D is a maritime freight consultant working out of the Port of Liverpool with around £58,000 of self-employed consulting income. He transitioned from a salaried port-services management role into consulting around three and a half years ago, never formally registered for self-assessment, and only realised something was wrong when HMRC issued determination assessments for the missing years and Failure to Notify penalties totalling around £2,400. His initial Time to Pay request had been declined because the underlying returns had not been filed.

We registered him for self-assessment retrospectively, reconstructed the trading position for each of the three missing years from his business bank account and invoice records, calculated the proper tax and Class 4 NIC liability for each year (which was substantially lower than the determination assessments HMRC had issued), and filed all three returns within six weeks. We then formally appealed the Failure to Notify penalties on the grounds that the move from PAYE to self-employment had been informally advised by his former employer's HR team as 'something HMRC would pick up automatically', which constituted a reasonable excuse.

HMRC accepted the appeal and reduced the penalties to a single fixed-penalty figure of £300. We then negotiated a 24-month Time to Pay arrangement on the underlying tax. The client is now fully compliant, ahead of his current-year obligations, and saved around £2,100 in penalties plus around £4,800 in overstated tax from the original determinations. He continues with us on an ongoing basis.
